1. Introduction

These Terms of Service ("Terms") govern your access to and use of ReadingScan ("we," "us," or "our"), an AI-powered medical imaging report interpretation service available at readingscan.com (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

2. Service Description

ReadingScan provides AI-powered interpretation of medical imaging scans. You upload medical images (such as X-rays, MRIs, or CT scans in JPG/PNG format), and our AI technology analyzes the image and generates a patient-friendly interpretation report in your preferred language.

The Service operates on a credit-based system. Each interpretation consumes credits from your account balance. Credits can be purchased through credit packages via our website.

3. Medical Disclaimer

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

• ReadingScan is NOT a medical device, diagnostic tool, or healthcare provider.
• The AI-generated interpretation reports are for informational and educational purposes only.
• Reports do NOT constitute medical advice, diagnosis, prognosis, or treatment recommendations.
• The Service is NOT a substitute for professional medical judgment, clinical examination, or consultation with a qualified healthcare provider.
• You should ALWAYS consult a licensed physician or qualified healthcare professional for any medical concerns, before making health decisions, or for the official interpretation of your medical imaging.
• Do NOT delay seeking medical advice, disregard professional medical advice, or discontinue medical treatment based on information provided by our Service.
• AI technology has inherent limitations and may produce inaccurate, incomplete, or misleading results.

By using the Service, you acknowledge and agree that ReadingScan assumes no liability for any health decisions made based on the interpretation reports provided.

4. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you are 18 or older and have the legal capacity to agree to these Terms.

5. Account Terms

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately at support@readingscan.com if you suspect unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

6. Credit System

6.1 How Credits Work

• The Service uses a credit-based system. Each scan interpretation costs 10 credits.
• Credits are deducted from your account balance when an interpretation is initiated.
• Credits are non-transferable between accounts.

6.2 Purchasing Credits

• Credits are available for purchase in packages through our website.
• All prices are listed in US Dollars (USD) and are inclusive of the stated price. Applicable taxes may be added at checkout depending on your jurisdiction.
• Payments are processed securely by Stripe, Inc. We do not store your payment card details.

6.3 Registration Gift Credits

• New users may receive complimentary credits upon account registration.
• Gift credits are subject to a shorter expiration period (30 days from issuance) and cannot be refunded.

6.4 Credit Expiration

• Purchased credits expire 365 days from the date of purchase.
• Registration gift credits expire 30 days from the date of issuance.
• Expired credits are forfeited and cannot be restored or refunded.
• It is your responsibility to use credits before they expire.

6.5 Promotional Offers

• From time to time, we may offer promotional discounts or coupon codes.
• Promotional offers are subject to their own terms, may be limited in quantity or duration, and can be withdrawn at any time.
• Promotional credits or discounts cannot be combined unless explicitly stated.

7. Refund Policy

We offer refunds for purchased credit packages under the following conditions:

7.1 Unused Credits — Full Refund

If you have not used any credits from a purchased package, you are eligible for a full refund of the purchase price. The request must be made within 30 days of purchase.

7.2 Partially Used Credits — Prorated Refund

If you have used some credits from a purchased package, you are eligible for a prorated refund. The refund amount is calculated as follows:

For example, if you purchased a 40-credit package for $19.00 and used 10 credits, your refund would be: $19.00 × (30 ÷ 40) = $14.25. The request must be made within 30 days of purchase.

7.3 Fully Used Credits — No Refund

If all credits from a purchased package have been used, no refund is available.

7.4 General Refund Terms

• Refund requests must be submitted to support@readingscan.com.
• Refunds are processed back to the original payment method via Stripe.
• Registration gift credits and promotional credits are not eligible for refund.
• Expired credits are not eligible for refund.
• Refunds are typically processed within 5–10 business days.

8. User Content

8.1 Ownership

You retain all ownership rights to the medical images you upload to the Service. We do not claim ownership of your uploaded content.

8.2 License

By uploading images, you grant us a limited, non-exclusive license to process, analyze, and store the images solely for the purpose of providing the Service to you. This license terminates when you delete the images or your account.

8.3 Your Responsibilities

• You represent that you have the legal right to upload and share the images you submit.
• You are solely responsible for ensuring that uploaded images do not contain personal identifiers of third parties without their consent.
• You must not upload content that is illegal, harmful, or violates the rights of others.

8.4 Data Retention

Uploaded images and associated reports are retained until you manually delete them from your account. Upon account deletion, all associated images and reports will be permanently deleted within 30 days.

9. Prohibited Activities

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload images that you do not have the legal right to share
• Attempt to reverse-engineer, decompile, or extract the underlying AI models or algorithms
• Use automated tools (bots, scrapers) to access the Service
• Interfere with or disrupt the integrity or performance of the Service
• Share your account credentials with third parties
• Resell, redistribute, or commercially exploit interpretation reports for third-party use
• Use the Service to process images for the purpose of providing medical services to others without proper licensing

10. Intellectual Property

The Service, including its design, software, AI models, branding, and documentation, is the property of ReadingScan and is protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated reports will be accurate, complete, or reliable
• The Service will meet your specific requirements or expectations
• Any errors in the Service will be corrected

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• ReadingScan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• ReadingScan shall not be liable for any health outcomes, medical decisions, or consequences arising from reliance on AI-generated interpretation reports.
• Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to ReadingScan in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless ReadingScan from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

• You may terminate your account at any time by contacting us or using the account deletion feature.
• We may suspend or terminate your access at any time for violation of these Terms, with or without notice.
• Upon termination, your right to use the Service ceases immediately.
• Unused credits at the time of termination are subject to the Refund Policy (Section 7).
• Sections 3 (Medical Disclaimer), 11 (Disclaimers), 12 (Limitation of Liability), and 13 (Indemnification) survive termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Effective Date" at the top of this page and notify you via email or a prominent notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
